Training Waiver & Release of Liability

Definitions: “Black Market Training” ABN 31 63814 8339 means the Training company. “The Training” means the event on the date listed above where the practice of coffee making will occur. “The Location” will be the place where The Training will occur, being 24 Cadogan St, Marrickville subject to change. “The Instructor” being the representative of Black Market Training. RISK WARNING: COFFEE MAKING AND ROASTING ACTIVITIES POSE A RISK OF PHYSICAL HARM, PERSONAL INJURY AND SOMETIMES PERMANENT DISABILITY AND/OR DEATH. ANY SUCH HARM MAY NOT ONLY BE FROM YOUR ACTIONS, BUT FROM THE ACTION, OMISSION OR NEGLIGENCE OF OTHERS. In consideration for and as a condition for my involvement in The Training, I:

1. Warrant that I am medically fit (physically and mentally) to participate in the training and have not been advised otherwise by a medical practitioner;
2. Warrant that I will follow the safety brief and any other guidelines of the Instructor, including but not limited to wearing of the appropriate footwear and high visibility jacket and use walkways designed for training participants
3. Acknowledge the risk warning set out in bold and capitals and I agree that I assume all risk related to the training and acknowledge that the Training Company is not liable for the breach of any express or implied warranty that services it provides will be provided with reasonable care and skill;
4. Release the Training company from liability for injuries resulting from the ordinary negligence of the Training Provider or any of its representatives;
5. Agree that I will abide by the rules and conditions of the Training including those in any literature or verbal or written.

Release and Indemnity: In consideration of Black Market Training accepting my application for participation, I, to the extent permitted by law:

1. Release and will release Black Market Training from all Claims that I may have or may have had but for this release arising from or in connection with my participation in any Training Activities; and
2. Indemnify and will keep indemnified Black Market Training in respect of any Claim by any person arising as a result of or in connection with my participation in any Training Activities.

I have read the entire document, understand, acknowledge and agree to the above terms including the warning, exclusion of implied terms, release and indemnity. I certify that I am over the age of 18 years. I also understand, acknowledge and agree to participate in the Training and exercise caution on the date indicated above.
